Thanks for bringing that to our attention, Daniel.
It's an interesting read and makes some sensible recommendations (recs.
4 through 10 especially).
I found the section on TPP (pages 119 to 120) of particular interest.
Whilst the Committee's report naturally focusses on PIRs, its findings
in relation to TPP in several way echo what OSIA said in our submission
to DFAT of TPP:
Paragraph 4.123 documents an actual occurrence of the TPP's secret
negotiating process being used to stymie parliamentary process (as
predicted in the OSIA submission on TPP, Section 1.1).
The quote from the JSC on Treaties at para. 4.127 ("confidentiality is
not common or appropriate in IP negotiations which impact directly and
in minute detail on on domestic law and domestic innovation policy") is
the icing on the cake. The JSCT report was referring to ACTA, not TPP,
but clearly the HSCIT see the same issue with the TPP process, as do we.
Paragraph 4.124 raises the concern that TPP would "tightly constrain
Australia's freedom to adopt its own regime governing the use of ...
TPMs" (as raised in OSIA submission on TPP, Section 2.1).
Paragraph 4.128 notes the ALRC's ongoing review into copyright & the
digital economy and agrees with the JSCT that "any international
agreement relating to intellectual property should not pre-empt the
outcome of, nor be incompatible with, those reviews" (as raised in OSIA
submission on TPP, Section 1.2 item 2).
